Do it in Writing
When negotiating with your People Leader about taking or deferring annual leave or long service leave the best way to make sure everyone plays by the rules is to get everything in writing. That includes putting requests in writing and insisting that your People Leader does the same.

Can I Get a Compliance Breach for not meeting Leave Requirements?
FSU members have raised concerns about amber gate ratings for not meeting arbitrary requirements to submit leave requests or to take leave within specified timeframes.

You shouldn’t be penalised in these circumstances and any threat or penalty could constitute “adverse action”, a breach of the Fair Work Act. It is important that we provide advice on your specific circumstances so please call or email the Member Rights Centre for tailored advice.
